An illegal immigrant has been charged with first-degree murder after an 8-year-old girl was killed and seven others were injured in a major vehicle collision near San Diego, California.

In a Friday press release, the Department of Homeland Security confirmed that U.S. Immigration and Customs Enforcement (ICE) lodged an arrest detainer for Brayan Alva-Rodriguez, an illegal immigrant from Guatemala, who caused a fatal collision near San Diego and is suspected of driving under the influence last Sunday.

The Department of Homeland Security cited a report from The San Diego Union-Tribune regarding the fatal vehicle collision.

“Alva-Rodriguez was driving a 2005 Toyota Tacoma with a 24-year-old passenger when he recklessly crossed over the solid double-yellow line into oncoming traffic and collided head-on with a 2018 Toyota Camry,” the department stated. According to The San Diego Union-Tribune, the illegal immigrant’s Tacoma also crashed into a Ford F-350 with a utility trailer, resulting in the Tacoma flipping and erupting into flames.

The San Diego Union-Tribune reported that five victims were transported by helicopter to local hospitals, while three other victims were transported by ambulance. The outlet noted that an 8-year-old girl ultimately died from her injuries.

According to The New York Post, Alva-Rodriguez was booked at the San Diego County Sheriff’s Department last Thursday and charged with first-degree murder, felony charges for driving under the influence and causing bodily injury to the victims, and two felony counts of gross vehicular manslaughter.

The Department of Homeland Security confirmed that Alva-Rodriguez has a “history of driving under the influence.” According to Friday’s press release, the illegal immigrant was previously arrested in 2020 for driving under the influence and was arrested a second time in 2021 for driving under the influence. Alva-Rodriguez was charged with a hit and run in the second incident.

“How many deaths of children at the hands of criminal illegal aliens need to happen before Governor Newsom and sanctuary politicians will prioritize the safety and security of American families? This serial drunk driver should have never been allowed back onto California roads,” Assistant Homeland Security Secretary Tricia McLaughlin said.

“We are praying for the family of this child who will be grieving this holiday season,” McLaughlin added. “Secretary Noem is calling on Governor Newsom to honor this ICE arrest detainer for this illegal alien.”
