An illegal immigrant was sentenced last Wednesday to life in prison after pleading guilty to murdering a woman in West Virginia. The woman’s body was found burned under a couch on the side of the road last May.
According to The Post Millennial, David Calderon, a 47-year-old illegal immigrant from El Salvador, was sentenced on Wednesday in the Jefferson County Circuit Court after pleading guilty to the murder of 32-year-old Samantha Dailey as part of an Alford plea, which allows the illegal immigrant to maintain his innocence.
The Post Millennial reported that Dailey’s body was found significantly burned and hidden under a couch. The outlet noted that while Calderon was sentenced to life in prison and will not be eligible for parole for at least 19 years, the illegal immigrant’s sentence gives him the possibility of parole after 15 years.
According to Metro News, during Wednesday’s sentencing, Joshua Dailey, Samantha Dailey’s uncle, criticized law enforcement and immigration officials for allowing Calderon to remain free in the United States after being denied entrance by Canada.
“I stay awake at night. At work, I lose focus,” Joshua Dailey stated. “I think about her last moments and what I would have done.”
“She was a bright light in this world and it can be said she never knew a stranger,” the victim’s uncle added. “But it took a stranger to extinguish her light.”

Addressing Calderon’s prison sentence with the possibility of parole, Joshua Dailey said, “We will not receive justice while he receives privileges he deprived Samantha of.”
While Calderon pleaded guilty to the murder of Samantha Dailey, the illegal immigrant from El Salvador refused to apologize for Dailey’s murder during Wednesday’s sentencing hearing. Speaking through an interpreter, the 47-year-old illegal immigrant said, “God will judge us individually and he knows the reality of everything.”
According to Metro News, Assistant Jefferson County Prosecutor Adam Ward described the illegal immigrant as a “dangerous and violent individual” and noted that Calderon failed to give Dailey’s family closure by refusing to reveal how she died.
Metro News reported that Judge David Hammer claimed that Calderon will be arrested by U.S. Immigration and Customs Enforcement (ICE) if he is granted parole in the future.
“The federal government has a detainer on the defendant and if he is ever granted parole, the federal government will immediately take him into custody,” Hammer said. “He will be deported. He will never walk the streets again.”
