Video: Illegal immigrant teen sentenced to probation after causing fatal crash

A 15-year-old illegal immigrant was recently sentenced to probation and community service after causing a fatal crash that killed a 24-year-old in Aurora, Colorado, last July.

According to CBS News, the 15-year-old illegal immigrant killed 24-year-old Kaitlyn Weaver in Aurora by crashing a Jeep into the side of Weaver’s vehicle. The outlet noted that John Weaver, the 24-year-old’s father, claimed that the Arapahoe District Attorney’s Office initially promised that prosecutors would push for the illegal immigrant teen to face the maximum sentence of two years in a correctional facility but that the district attorney’s office changed its course of action after the leadership changed.

“The DA’s office said this would be a ‘no plea deal’ case, so they were not going to offer anything; any concession,” Weaver said.

CBS News reported that the 24-year-old victim was driving home when the 15-year-old illegal immigrant crashed into her car while driving over 90 miles per hour in a residential area with a speed limit of 45 miles per hour.

“She didn’t even see him coming,” Weaver said. “That’s how fast he was going. She was effectively killed instantly.”

CBS News reported that other minors were in the vehicle with the 15-year-old illegal immigrant at the time of last year’s fatal crash. The outlet noted that the illegal immigrant had been driving the vehicle illegally, that the Jeep was uninsured, and that his mother claimed the 15-year-old had taken the vehicle without her permission. According to CBS News, the teenager was charged with vehicular homicide following the incident.

Weaver told CBS News that under the new leadership of District Attorney Amy Padden, a Democrat, the illegal immigrant received a guilty plea deal of two years of probation and 100 hours of community service.

In response to the plea deal, Weaver said, “Why the change? If he had taken a firearm and recklessly just shot it and killed someone, this would be a different case. They would be pushing it completely differently. There’s no deterrence.”

Weaver added, “Immigration and the criminal justice system and all these things landed together one day in Aurora, and now I sit here today without a daughter.”

According to CBS News, Arapahoe County Assistant District Attorney Ryan Brackley claimed that the plea deal was not influenced by Padden and that the deal was handled by an experienced prosecutor.

In a statement obtained by CBS News, Brackley said prosecutors consider “the impact on the victims and the community,” “the characteristics of the defendant such as age, culpability, and level of remorse,” and the “goals of sentencing, including deterrence, rehabilitating the offender, treating similarly situated offenders equitably, and holding each offender accountable” before negotiating a plea deal.
