Pic: Illegal immigrant released from jail after allegedly raping disabled person

U.S. Immigration and Customs Enforcement (ICE) recently arrested an illegal immigrant who had been released from custody after initially being arrested on charges of rape, battery, and indecent assault against a “developmentally disabled person.”

In a statement released on Wednesday, ICE officials noted that Enforcement and Removal Operations (ERO) arrested an “unlawfully present Haitian national” on January 9 who had previously been arrested for “charges of rape and indecent assault and battery on a developmentally disabled person in Dorchester.”

While ERO Boston issued an immigration detainer against the individual, the Dorchester District Court ultimately released the illegal immigrant from jail.

Bill Melugin, a Fox News correspondent, shared a photo of the suspect, who was identified by an anonymous ICE source as Pierre Lucard Emile, on X, formerly Twitter.

“Source also provided a photo of him from federal database,” Melugin stated. “His name was not included in the ICE press release. He remains in ICE custody.”

“Disturbingly and despite our filing an immigration detainer, this individual was released back into the community by the criminal court,” ERO Field Office Director Todd M. Lyons said in Wednesday’s press release. “The men and women of ERO Boston continue to protect the community from those who pose a real public safety threat to our communities.”

According to ICE, the alleged rape suspect illegally crossed into the United States in December of 2022 in Brownsville, Texas. At the time, the suspect was given a notice requiring him to appear in court before an immigration judge.

After the suspect’s arrest in September of 2023 by Boston police officers, ERO Boston submitted an immigration detainer with the Dorchester District Court for custody of the suspect; however, the illegal immigrant was released from custody on November 8, 2023, with an electronic monitoring device, according to ICE.

“After becoming aware of his recent arrest and unlawful immigration status, ERO Boston began an investigation to confirm the Haitian citizen’s presence its area of responsibility,” ICE stated. “Following confirmation of his presence, officers with ERO Boston arrested him without incident in Dorchester Jan. 9.”

According to ICE, charges against the illegal immigrant are currently “pending with the local criminal court.” As a result, the suspect will remain in ICE’s custody until an upcoming hearing with an immigration judge from the Department of Justice. ERO Boston is seeking the removal of the suspect from the United States.
