Upstate NY man arrested for threat to President Biden: ‘Gonna put a bullet in your head’

An Upstate New York man has been arrested for allegedly threatening to kill President Joe Biden.

Troy Kelly, 19, of Crown Point, N.Y., was arrested Tuesday and charged via criminal complaint with making threats against the President of the United States. He appeared in Albany court before U.S. Magistrate Judge Christian F. Hummel, and was detained pending a full detention hearing scheduled for Friday, June 28.

According to the criminal complaint, Kelly allegedly responded to a social media post on X (formerly known as Twitter) by Biden with the sentence: “Gonna put a bullet in your head if I ever catch you.”

A Secret Service investigation revealed Kelly was the likely user of the account that posted the threat and proceeded to interview him at his home. During the interview, Kelly confirmed he posted the threat and said he still wanted to kill the president.

“If I could, I would,” Kelly told the Secret Service agent, according to the complaint.

Kelly was charged with one count of making threats against the President of the United States. He faces a maximum sentence of 5 years imprisonment, a fine of up to $250,000, and a term of supervised release following any term of incarceration of up to three years.

Kelly’s arrest was announced Wednesday by U.S. Attorney Carla B. Freedman; Lewis Robinson, Special Agent in Charge of the Buffalo Field Office of United States Secret Service; Matthew Scarpino, Special Agent in Charge of the Buffalo Field Office of Homeland Security Investigations; and Steven James, Superintendent of the New York State Police.

The U.S. Secret Service, Homeland Security Investigations, and the New York State Police are investigating the case, which is being prosecuted by Assistant U.S. Attorney Joseph S. Hartunian.

Crown Point is located in Essex County, about 100 miles north of Albany.
