Cliven Bundy Suing Federal Government Over Constitutional Rights

Nevada cattle rancher Cliven Bundy has filed a lawsuit against the federal government including President Obama, U.S. District Court Judge Gloria Navarro, Senator Harry Reid, and Rory Reid claiming they violated his constitutional rights.

Bundy was arrested on February 10, 2016 in Portland while attempting to support militants at Malheur National Wildlife Refuge in Burns, Oregon. His two sons, Ammon and Ryan Bundy were there engaging in a month long occupation.

Bundy became famous back in 2014 in his stance over grazing rights between his family and the Bureau of Land Management. Bundy chose to not renew his permit for cattle grazing on BLM lands. There was a court order that was intended to confiscate 500 of Bundy’s cattle and to collect one million dollars in grazing fees. Bundy said that the government was overstepping in the matter and as a result, many armed supporters came to his side.

He now faces multiple charges against him such as one count of conspiracy to commit an offense against the United States, one count of assault on a federal officer by use of a deadly weapon and aiding and abetting, two counts of use and carrying of a firearm in relation to a crime of violence and aiding and abetting, one count of interfering with commerce by extortion and aiding and abetting, and one count of obstruction of the administration of justice and aiding and abetting.

In the complaint, Bundy states that he is innocent. It alleges the defendants violated multiple constitutional rights such as the sixth amendment which gives the right to counsel and a speedy trial, the eight amendment which protects against cruel and unusual punishment, the first amendment which gives the right to assemble and the second amendment which gives the right to bear arms.

In the lawsuit, Bundy claims that he has been in solitary since he was arrested back in February.

Bundy has also accused Obama of acting in a “threatening, mocking and disparaging” manner when Obama mentioned him in the 2014 White House Correspondent’s Dinner.

The complaint also cites that President Obama, Senator Reid and his son planned to take hold of Bundy’s land and sell the property in the interest of the Chinese.

Bundy is also seeking $50 million for “illegal, unconstitutional, intentional and malicious acts.”
